These Terms & Conditions govern the use of the ShipControl platform, website, applications, and related logistics management services.

By using ShipControl, the user agrees to comply with these terms.

1. Service Description

ShipControl provides software tools for managing logistics operations, including shipment management, suppliers, delivery agents, branches, warehouses, shipment statuses, operational workflows, financial settlements, and other related logistics functions.

The exact features available to a customer may depend on the selected subscription and enabled services.

2. Account Responsibility

Users are responsible for:

• Providing accurate information when using the platform.
• Keeping their account credentials secure.
• Ensuring that only authorized persons access their accounts.
• Using the platform only for lawful business and logistics activities.

Users are responsible for the information and operational data entered into ShipControl through their accounts.

3. Acceptable Use

ShipControl must not be used for:

• Illegal activities.
• Unauthorized access to systems or information.
• Fraudulent or abusive activities.
• Attempting to disrupt, damage, overload, or interfere with the platform.
• Using the service in a way that violates applicable laws or the rights of others.

ShipControl may restrict or suspend access in cases of serious misuse or violation of these terms.

4. Subscription and Payments

Access to paid ShipControl services is provided according to the selected subscription or services.

Subscription prices, available features, and billing periods may vary according to the selected plan or commercial agreement.

Customers are responsible for paying the applicable subscription fees according to the agreed payment terms.

Failure to complete required payments may result in suspension or restriction of paid services.

5. Refund Policy

A refund may be requested within the first 7 days from the start of the paid subscription, provided that the service has not been actually used during that period.

If the platform or any of its core operational features have been used, the subscription will be considered active and the paid amount will not be eligible for a refund.

Refund requests are subject to verification of account activity and subscription status.

6. Cancellation

Customers may choose not to renew their subscription.

Cancellation prevents future renewal but does not automatically create a right to a refund for a subscription period that has already started, except where the Refund Policy above applies.

7. Service Availability

ShipControl aims to provide reliable and continuous access to the platform.

However, temporary interruptions may occur due to:

• Maintenance.
• Security updates.
• Technical issues.
• Infrastructure or third-party service interruptions.
• Circumstances outside ShipControl's reasonable control.

ShipControl may perform maintenance or updates when necessary to maintain the security, stability, or functionality of the service.

8. Customer Data

Customers remain responsible for the logistics and operational information entered into their ShipControl accounts.

ShipControl processes such information only as necessary to provide and operate the platform services.

The handling of personal and operational information is also subject to the ShipControl Privacy Policy.

9. Intellectual Property

The ShipControl platform, software, design, branding, source code, features, and related intellectual property remain the property of their respective owners.

Use of the service does not transfer ownership of the software or intellectual property to the customer.

Customers are granted the right to use the platform according to their active subscription and these Terms & Conditions.

10. Limitation of Liability

ShipControl provides software tools to assist customers in managing logistics operations.

Customers remain responsible for their own business decisions, operational processes, shipment information, employees, suppliers, delivery agents, and dealings with their own customers.

ShipControl will not be responsible for losses resulting from incorrect information entered by users, misuse of the platform, unauthorized use of customer accounts, or circumstances outside ShipControl's reasonable control.

11. Account Suspension or Termination

ShipControl may suspend or restrict access to an account where necessary in cases including:

• Non-payment.
• Serious violation of these Terms & Conditions.
• Fraudulent or abusive use.
• Security threats.
• Illegal use of the platform.

Where appropriate, reasonable efforts may be made to notify the customer.

12. Changes to the Service

ShipControl may improve, modify, add, or remove features as the platform evolves.

Changes may be made to improve security, performance, usability, or the functionality of the service.

13. Changes to These Terms

These Terms & Conditions may be updated when necessary to reflect changes to ShipControl services or applicable requirements.

The latest version will be published on the official ShipControl website together with the date of the latest update.

تنظم هذه الشروط والأحكام استخدام منصة ShipControl والموقع والتطبيقات والخدمات المرتبطة بإدارة العمليات اللوجستية.

باستخدام ShipControl، يوافق المستخدم على الالتزام بهذه الشروط.

1. وصف الخدمة

توفر ShipControl أدوات برمجية لإدارة العمليات اللوجستية، بما في ذلك إدارة الشحنات، والموردين، والمندوبين، والفروع، والمخازن، وحالات الشحنات، وسير العمليات التشغيلية، والتسويات المالية، وغيرها من الوظائف المرتبطة بالخدمات اللوجستية.

2. مسؤولية الحساب

يتحمل المستخدم مسؤولية:

• التأكد من أن الأشخاص المصرح لهم فقط يمكنهم الوصول إلى الحساب.

ويتحمل المستخدم مسؤولية المعلومات والبيانات التشغيلية التي يتم إدخالها إلى ShipControl من خلال حسابه.

3. الاستخدام المقبول

لا يجوز استخدام ShipControl في:

• الأنشطة غير القانونية.
• الوصول غير المصرح به إلى الأنظمة أو المعلومات.
• الأنشطة الاحتيالية أو المسيئة.
• محاولة تعطيل المنصة أو الإضرار بها أو تحميلها بصورة تؤثر على تشغيلها.
• استخدام الخدمة بطريقة تخالف القوانين المعمول بها أو حقوق الآخرين.

ويجوز لـ ShipControl تقييد أو تعليق الوصول في حالات إساءة الاستخدام الجسيمة أو مخالفة هذه الشروط.

4. الاشتراكات والمدفوعات

يتم توفير خدمات ShipControl المدفوعة وفقًا للاشتراك أو الخدمات التي يختارها العميل.

وقد تختلف أسعار الاشتراكات والوظائف المتاحة وفترات الدفع وفقًا للخطة المختارة أو الاتفاق التجاري.

يتحمل العميل مسؤولية دفع رسوم الاشتراك المستحقة وفقًا لشروط الدفع المتفق عليها.

وقد يؤدي عدم استكمال المدفوعات المطلوبة إلى تعليق أو تقييد الخدمات المدفوعة.

5. سياسة استرداد الأموال

يمكن طلب استرداد المبلغ خلال أول 7 أيام من بداية الاشتراك المدفوع، بشرط ألا تكون الخدمة قد تم استخدامها فعليًا خلال هذه الفترة.

في حالة استخدام المنصة أو أي من وظائفها التشغيلية الأساسية، يُعتبر الاشتراك قد بدأ استخدامه فعليًا، ولا يكون المبلغ المدفوع مؤهلًا للاسترداد.

تخضع طلبات الاسترداد لمراجعة نشاط الحساب وحالة الاشتراك.

6. إلغاء الاشتراك

يمكن للعميل اختيار عدم تجديد اشتراكه.

ويمنع الإلغاء عمليات التجديد المستقبلية، ولكنه لا يمنح تلقائيًا حق استرداد قيمة فترة اشتراك بدأت بالفعل، إلا إذا انطبقت شروط سياسة استرداد الأموال الموضحة أعلاه.

7. توفر الخدمة

تسعى ShipControl إلى توفير وصول مستقر ومستمر إلى المنصة.

ومع ذلك، قد تحدث انقطاعات مؤقتة بسبب:

• أعمال الصيانة.
• التحديثات الأمنية.
• المشكلات التقنية.
• أعطال البنية التحتية أو الخدمات الخارجية.
• ظروف خارجة عن السيطرة المعقولة لـ ShipControl.

وقد تقوم ShipControl بتنفيذ أعمال الصيانة أو التحديثات عند الحاجة للحفاظ على أمان الخدمة واستقرارها ووظائفها.

8. بيانات العميل

يتحمل العميل مسؤولية المعلومات اللوجستية والتشغيلية التي يتم إدخالها إلى حسابه في ShipControl.

وتقوم ShipControl بمعالجة هذه المعلومات فقط بالقدر اللازم لتشغيل وتقديم خدمات المنصة.

كما تخضع معالجة البيانات الشخصية والتشغيلية لسياسة الخصوصية الخاصة بـ ShipControl.

9. الملكية الفكرية

تظل منصة ShipControl والبرمجيات والتصميم والعلامة التجارية والكود المصدري والوظائف والحقوق الفكرية المرتبطة بها ملكًا لأصحابها.

ولا يؤدي استخدام الخدمة إلى نقل ملكية البرمجيات أو حقوق الملكية الفكرية إلى العميل.

ويُمنح العميل حق استخدام المنصة وفقًا لاشتراكه النشط وهذه الشروط والأحكام.

10. حدود المسؤولية

توفر ShipControl أدوات برمجية تساعد العملاء في إدارة العمليات اللوجستية.

ويظل العميل مسؤولًا عن قراراته التجارية وعملياته التشغيلية وبيانات الشحنات والعاملين لديه والموردين والمندوبين والتعاملات مع عملائه.

ولا تتحمل ShipControl المسؤولية عن الخسائر الناتجة عن إدخال معلومات غير صحيحة من قبل المستخدمين، أو إساءة استخدام المنصة، أو الاستخدام غير المصرح به لحساب العميل، أو الظروف الخارجة عن السيطرة المعقولة لـ ShipControl.

11. تعليق أو إنهاء الحساب

يجوز لـ ShipControl تعليق أو تقييد الوصول إلى الحساب عند الحاجة في حالات تشمل:

• عدم السداد.
• المخالفة الجسيمة لهذه الشروط والأحكام.
• الاستخدام الاحتيالي أو المسيء.
• وجود تهديدات أمنية.
• الاستخدام غير القانوني للمنصة.

وعندما يكون ذلك مناسبًا، قد يتم بذل جهود معقولة لإبلاغ العميل.

12. التغييرات على الخدمة

يجوز لـ ShipControl تحسين أو تعديل أو إضافة أو إزالة بعض الوظائف مع تطور المنصة.

وقد يتم إجراء هذه التغييرات لتحسين الأمان أو الأداء أو سهولة الاستخدام أو وظائف الخدمة.

13. التغييرات على الشروط والأحكام

قد يتم تحديث هذه الشروط والأحكام عند الحاجة لتعكس أي تغييرات في خدمات ShipControl أو المتطلبات المطبقة.

وسيتم نشر أحدث نسخة على الموقع الرسمي لـ ShipControl مع توضيح تاريخ آخر تحديث.
